Yassuh Digital Mailbox — Terms of Service

Effective date: 11 August 2026.

1. Acceptance of These Terms

Welcome to Yassuh Digital Mailbox ("Yassuh," "the Service," "we," "us," or "our"). These Terms of Service ("Terms") are a legal agreement between you and Yassuh and govern your access to and use of our mobile application, websites, portals, application programming interfaces (APIs), and related services.

By creating an account, registering your phone number, tapping "I agree" (or a similar control), installing the app, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not access or use the Service.

If you are using the Service on behalf of an organization (for example, as an organization administrator, sender, or partner integrator), you represent that you are authorized to bind that organization, and "you" also refers to that organization. Additional terms in a separate written agreement may apply to organizations and partners; where those terms conflict with these Terms, the separate agreement controls for that organization or partner.

2. Eligibility

To use the Service you must be at least 18 years of age, or the age of majority in your jurisdiction, or you must have the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use.

You must be capable of forming a binding contract under applicable law and must not be barred from using the Service under the laws of Jamaica or any other applicable jurisdiction. You agree to provide accurate, current, and complete information when you register, including a valid phone number, your name, and your parish, and to keep that information up to date.

The Service is designed primarily for users in Jamaica. We make no representation that the Service is appropriate or available for use in other locations.

3. Description of the Service — One-Way Messaging

Yassuh is a one-way messaging and alerting platform. Verified organizations — such as government agencies, emergency services, utilities, financial institutions, and news providers — can send messages, notices, and alerts to citizens who use the app. The Service also relays certain automated content from third-party sources, including weather information and news headlines (see the section on Automated Content and External Links).

The Service is strictly one-way. You cannot use Yassuh to reply to, message, or otherwise communicate with any organization, sender, or other user through the Service. There is no reply path, chat, or two-way channel of any kind. Yassuh is not an emergency service, a 911/119 replacement, a telephone or SMS carrier, or a substitute for direct contact with any organization or authority.

Message categories may include, without limitation: emergency alerts (such as flood or storm warnings), official notices, informational messages, and commercial messages. You can subscribe to organizations you wish to receive messages from, and you may receive certain location-targeted alerts (for example, emergency alerts geofenced to your area) even where you have not individually subscribed, so that important safety information can reach you. We may add, change, or remove features, message categories, or organizations at any time.

4. No Guarantee of Delivery, Timeliness, Accuracy, or Availability — Do Not Rely on Yassuh as Your Sole Source, Especially for Emergencies

THIS IS ONE OF THE MOST IMPORTANT SECTIONS OF THESE TERMS. PLEASE READ IT CAREFULLY.

Yassuh does NOT guarantee that any message — including any emergency alert — will be delivered, will be delivered on time, will be accurate, or will be received by you at all. Messages are delivered over the public internet and through third-party push-notification services (such as Firebase Cloud Messaging operated by Google) and mobile networks that we do not control. Delivery may be delayed, throttled, duplicated, reordered, degraded, or may fail entirely for many reasons beyond our control, including but not limited to: no or poor internet or mobile coverage; your device being off, asleep, in low-power mode, or out of storage; notifications, background data, or permissions being disabled; operating-system limits on background delivery; app-store, device, or carrier restrictions; outages at Google, your carrier, or other providers; or maintenance, faults, or attacks on any system in the delivery chain.

DO NOT RELY ON YASSUH AS YOUR ONLY OR PRIMARY SOURCE OF EMERGENCY, SAFETY, WEATHER, OR OTHER TIME-CRITICAL INFORMATION. In an emergency, or when severe weather or other hazards may be present, you must monitor and follow official government channels and instructions — including the Office of Disaster Preparedness and Emergency Management (ODPEM), the Meteorological Service of Jamaica, the Jamaica Constabulary Force, the Jamaica Fire Brigade, local parish authorities, official radio and television broadcasts, and emergency telephone numbers. Always follow the directions of official authorities. A message received through Yassuh (or the absence of any message) must never be treated as confirmation that a hazard does or does not exist.

The Service and all messages are provided on an "as available" basis. We do not guarantee that the Service will be uninterrupted, available at any particular time, error-free, or secure, and we may suspend, limit, or discontinue all or part of the Service at any time without notice or liability.

5. Third-Party and Organization Content — Yassuh Is a Conduit, Not the Author

Messages, alerts, notices, weather information, news headlines, links, images, and other content delivered through the Service ("Content") originate from third parties, including the sending organizations and external data providers. Yassuh acts only as a conduit or pipe that transmits this Content; we are not the author, publisher, originator, or guarantor of it.

We do not create, verify, endorse, monitor, edit, or independently confirm the accuracy, completeness, legality, timeliness, or reliability of organization or third-party Content, and we do not adopt or take responsibility for it. Any opinions, advice, statements, instructions, offers, or other information in the Content are those of the originating organization or third party, not of Yassuh. Your reliance on any Content is at your own risk.

Any dealings you have with an organization or third party as a result of the Service — including responding to a notice, acting on an alert, or accepting a commercial offer — are solely between you and that organization or third party. Yassuh is not a party to and is not responsible for those dealings, the underlying goods or services, or any resulting loss or dispute. If you believe Content is inaccurate, unlawful, or objectionable, please contact the originating organization and, where appropriate, notify us.

6. Accounts, Verification, and Security

To use most features you must create an account. We verify your phone number using a one-time code (OTP) and you set a password used with your phone number to sign in. You are responsible for maintaining the confidentiality of your account credentials, your OTP codes, and your device, and for all activity that occurs under your account.

You agree to: (a) provide accurate registration information and keep it current; (b) keep your password and codes secret and not share your account; (c) use a device and phone number you are authorized to use; and (d) notify us promptly at the contact address below if you suspect any unauthorized access to or use of your account. We are not liable for any loss arising from unauthorized use of your account, including where you failed to safeguard your credentials or device.

We may refuse, suspend, limit, or cancel accounts, reclaim usernames or identifiers, or require re-verification, at our discretion, including where we suspect fraud, security risks, or breach of these Terms.

7. Your Data, Location, and Push Tokens

To provide the Service we collect and process certain information about you, including your phone number, name, parish, device location (used to target geofenced alerts to your area), and push-notification tokens, together with related usage and delivery data. Our collection and use of this information is described in our Privacy Policy, which forms part of these Terms.

Location-based targeting depends on the location information available to us and on device and operating-system settings and permissions. If you disable location services or notification permissions, geofenced and other alerts may not reach you. Location and delivery data may be approximate, delayed, or unavailable, and you must not rely on location targeting to determine whether a hazard affects you.

By using the Service you consent to the transmission of your information to, and its processing by, the third-party providers necessary to operate the Service (such as push-notification, SMS, hosting, and mapping providers), which may be located outside Jamaica. You may manage certain preferences (such as subscriptions and notification settings) and may delete your account within the app; account deletion is handled as described in our Privacy Policy.

8. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not, and must not attempt to, and must not permit or assist any third party to:

Organizations, senders, and partner integrators additionally agree to send only Content they are authorized and legally permitted to send, to send emergency and safety messaging responsibly and truthfully, to comply with all applicable laws (including consumer-protection, data-protection, and anti-spam requirements), and to obtain any consents required from recipients. We may investigate and take action, including removing Content and suspending accounts, for any suspected violation.

9. Intellectual Property

The Service, including its software, design, user interfaces, text, graphics, logos, and the "Yassuh" name and marks, and all intellectual property rights in them, are owned by Yassuh or its licensors and are protected by copyright, trademark, and other laws. Except for the limited rights expressly granted below, we reserve all rights.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on a device you own or control, and to access the Service, solely for your personal, non-commercial use (or, for organizations and partners, for the internal business purposes authorized in your agreement). This license does not grant you any right to our source code or to modify, distribute, sell, or create derivative works from the Service.

Content transmitted through the Service belongs to the originating organization or third party or their licensors; nothing in these Terms transfers ownership of that Content to you. You must not remove or alter any proprietary notices. If you submit any feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you. Third-party names and marks appearing in Content are the property of their respective owners and do not imply endorsement by Yassuh.

10. Automated Content and External Links (Weather and News)

The Service relays automated content sourced from third parties for your convenience, including weather forecasts and observations (for example, from Open-Meteo) and news headlines (for example, from Jamaican news RSS feeds such as The Gleaner and the Jamaica Observer), often with links back to the original source.

This automated content is provided "as is," is generated and supplied by external providers, and may be inaccurate, incomplete, outdated, delayed, unavailable, or interrupted. Weather information in particular is a forecast or model output and is inherently uncertain; it must not be treated as an authoritative or official warning. For authoritative weather and hazard information, rely on the Meteorological Service of Jamaica, ODPEM, and other official sources.

We do not control, endorse, verify, or assume any responsibility for third-party content, feeds, websites, or resources linked to or made available through the Service, or for their accuracy, availability, security, or practices. Links and headlines are provided for convenience only; accessing any external site is at your own risk and subject to that site's own terms and policies. Automated content may be added, changed, or discontinued at any time without notice.

11. Disclaimer of Warranties ("As Is" / "As Available")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, MESSAGES, ALERTS, DATA, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE, ON OUR OWN BEHALF AND ON BEHALF OF OUR AFFILIATES, LICENSORS, AND SERVICE PROVIDERS, EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (a) THE SERVICE OR ANY MESSAGE OR ALERT WILL BE DELIVERED, TIMELY, ACCURATE, COMPLETE, RELIABLE, SECURE, OR AVAILABLE; (b) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED; (c) THE SERVICE OR ITS SERVERS ARE FREE OF VIRUSES OR HARMFUL COMPONENTS; OR (d) ANY CONTENT, INCLUDING EMERGENCY, WEATHER, OR NEWS CONTENT, IS ACCURATE OR RELIABLE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR STATUTORY GUARANTEES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU; IN THAT CASE, SUCH WARRANTIES ARE LIMITED TO THE MINIMUM EXTENT AND SHORTEST DURATION PERMITTED BY LAW. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE, CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND SUBJECT TO THE PARAGRAPH BELOW ON LIABILITY THAT CANNOT BE EXCLUDED:

(a) IN NO EVENT WILL YASSUH OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS, ARISING OUT OF OR RELATING TO THE SERVICE, THESE TERMS, ANY MESSAGE OR ALERT (INCLUDING ANY DELAYED, INACCURATE, UNDELIVERED, OR MISSED EMERGENCY ALERT), OR ANY THIRD-PARTY OR AUTOMATED CONTENT, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

(b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE TOTAL AMOUNTS YOU PAID TO US, IF ANY, FOR THE SERVICE IN THE SIX (6) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) FIVE THOUSAND JAMAICAN DOLLARS (JMD $5,000). BECAUSE THE SERVICE IS PROVIDED TO CITIZENS FREE OF CHARGE, YOU ACKNOWLEDGE THAT THIS ALLOCATION OF RISK IS REASONABLE AND IS AN ESSENTIAL BASIS OF THE BARGAIN.

These limitations apply to the fullest extent permitted by law and reflect the free, best-effort, conduit nature of the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the laws of Jamaica — for example, liability for death or personal injury caused by our own negligence, or for our own fraud or fraudulent misrepresentation. Where liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Yassuh and its affiliates, officers, directors, employees, agents, licensors, and service providers (the "Indemnified Parties") from and against any and all claims, demands, actions, liabilities, damages, losses, penalties, and expenses (including reasonable legal fees and costs) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of these Terms or of any applicable law or regulation; (c) your violation of the rights of any third party, including intellectual property, privacy, or publicity rights; (d) any Content you send, submit, or transmit through the Service (including, for organizations and partners, any message or alert you originate); or (e) your negligence or willful misconduct.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us. You may not settle any matter that affects the Indemnified Parties without our prior written consent. This section survives termination of these Terms.

14. Suspension and Termination

You may stop using the Service at any time and may delete your account through the app (Profile tab → Delete account) or, without the app, at https://mailbox.yassuh.dev/delete-account. Deleting your account ends your right to use the Service; certain records may be retained as described in our Privacy Policy or as required by law (for example, append-only audit records).

We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without notice, including where we reasonably believe you have violated these Terms, where required by law or by a provider, to protect the Service, other users, or third parties, or where continuing to provide the Service is no longer commercially or operationally viable. We may also discontinue the Service, or any feature or organization on it, in whole or in part, at any time.

Upon termination, the licenses granted to you end and you must stop using the Service. Provisions that by their nature should survive termination — including those on Content ownership, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution — survive.

15. Changes to These Terms and to the Service

We may modify these Terms from time to time. If we make material changes, we will take reasonable steps to notify you — for example, by posting the updated Terms in the app or on our website, updating the "Effective date," or sending an in-app message. Changes are effective when posted unless we state otherwise.

Your continued access to or use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may delete your account. We may also change, add, suspend, or remove features of the Service at any time, and we are not liable to you or any third party for doing so.

16. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of Jamaica, without regard to conflict-of-laws principles.

You and Yassuh agree that the courts of Jamaica have exclusive jurisdiction to settle any such dispute or claim, and you submit to the exclusive jurisdiction of those courts. Before commencing any formal proceedings, you agree to first contact us using the details below and to attempt in good faith to resolve the dispute informally; many concerns can be resolved quickly this way. Where the parties agree in writing, a dispute may instead be referred to arbitration or mediation in Jamaica in accordance with applicable Jamaican law.

To the extent permitted by law, any claim must be brought on an individual basis and not as part of any class or representative proceeding, and any cause of action must be commenced within the time period allowed by applicable Jamaican law.

17. Severability, Waiver, Assignment, and Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it will be severed, and the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision, and no waiver is effective unless in writing. You may not assign or transfer these Terms or your rights under them without our prior written consent; we may assign these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets.

These Terms, together with our Privacy Policy and any additional terms that apply to organizations or partners, constitute the entire agreement between you and Yassuh regarding the Service and supersede all prior or contemporaneous agreements, understandings, or communications on that subject. Section headings are for convenience only and do not affect interpretation. There are no third-party beneficiaries to these Terms except the Indemnified Parties, who may enforce the disclaimer, limitation-of-liability, and indemnification provisions.
